Visa Options
There are several visa options that allow businesses to sponsor overseas workers to work in Australia. They are:
- Temporary Business Sponsorship (457 visas) ***REPEALED****
- Temporary Work (Skilled) or 457 visa is now closed for new applications with effect from 18 March 2018. Any applications made before 18/03/2018 will be assessed in accordance with global processing times indicated by the Department of Immigration and Border Protection (Home Affairs).
- The Subclass 457 allowed businesses based either in Australia or overseas to sponsor workers for a temporary visa lasting up to 4 years. Only certain occupations were eligible for 457 visas, and employees must be paid at the market rate.
- A new TSS (Temporary Skill Shortage) visa (Subclass 482) has been introduced on 18 March 2018 (please check eligible occupations enlisted on most current relevant occupation list).
- Employer Nomination Scheme (ENS)
- The Employer Nomination Scheme is a permanent visa, and requires the nominating employer to be operating in Australia. The employee needs to show a higher level of skills, at least two years of experience and eligible occupation on the list. New age limits apply (45 years). The temporary visa holders on or before April 18 2017 and who applied before that date comes under the transitional arrangements and are thus exempted from new regulations.
- Regional Sponsored Skilled Migration Scheme (RSMS)
- The RSMS Subclass 187 visa requires a job offer in a regional area. The position needs to be approved by a Regional Certifying Body, now require equivalent level of skills that of ENS visa. Work experience is must as per new regulations introduced on 18 March 2018. The RSMS visa is a permanent visa, but is subject to cancellation if the employee does not commences employment within stipulated time frame or leaves employment within 2 years of obtaining the visa.
- Temporary Work (Short Stay Specialist) Subclass 400 Visas
- For people undertaking highly specialised work or they are working in Australia’s interest.
- Temporary Activity Subclass 408 Visas
- For people coming to Australia as an invited participant, on exchange with an Australian business, for sporting activities, as a religious worker, a Domestic worker, to work in the entertainment industry, for research activities with an Australian educational institution, or as part of a special program.
- Training Subclass 407 Visas
- For people working as an occupational trainee or as part of a professional development program.
